Waiver & Terms of Service Agreement
I, (as a participant or parent of a participant) acknowledge that I (or my son or daughter) am voluntarily participating in the Sports Training Classes, Fitness Training Classes, Private Fitness, Private Sports Training Sessions, Training Programs, Baseball Training Sessions (Hitting or Pitching, etc…), Baseball Field Play or Practice and Travel Ball Field Play, and Camps offered by or through Extreme Fitness & Sports (“EFS”) and Chris Morton (“CM”), and or The Dugout Baseball & Softball Training (“DBST”) and Scott Dawson (“SD”) during which I will receive information and instruction about sports, fitness, or health.
By checking “Accept” and submitting this form, I am stating confidently that I (or my son or daughter) am healthy and able to participate in physical exercise. If I (or my son or daughter) am not able to exercise safely, I will not check “Accept.”
I, as the participant (or my son or daughter) have the following relevant medical conditions. Only enter in medical-risk conditions that could impact exercise. If there are none, write “None” or leave blank.
I am aware that Sports, Fitness and Dance Classes or Training involve hazardous activities that may cause physical injury, including death. I am voluntarily participating in the Sports, Fitness or Dance Classes, or Baseball Training Sessions or Travel Ball Play and Practice offered by EFS and CM, and or DBST and SD with knowledge of the danger involved.
In consideration of being permitted by EFS and CM, and DBST and SD to participate in such Sports, Fitness or Dance Classes, or Baseball Training or Travel Ball Field Play, I hereby, accept and assume any and all risks of injury or death and other damages, known or unknown, that I may incur from such participation.
I understand that it is my responsibility to consult with a physician prior to and regarding my participation in Sports or Fitness Classes. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in Sports or Fitness Classes, or Baseball Training and/or Travel Ball Practice and Play.
I acknowledge that it is my responsibility to inform the instructor before any Sports, Fitness or Dance Classes, or Baseball Training and/or Travel Ball Practice or Games I attend of any injury and/or condition that might affect my ability to participate, and to inform the instructor immediately if an injury occurs during any Sports or Fitness or Baseball Classes or at any time while under the instruction of EFS or CM, DBST or SD.
I am aware that EFS, CM, DBST, SD and their contractors, officers, employees, representatives and agents are acting in reliance on the preceding statements in allowing me to participate in Sports or Fitness or Baseball Classes or Practices or Games.
In further consideration of being permitted by EFS to participate in Sports, Fitness or Dance Classes, or Baseball Training or Practices or Games, I hereby agree that I, my assignees, heirs, distributes, guardians or legal representatives forever release, waive, discharge and covenant not to make a claim against, sue or attach the property of EFS and CM, DBST and SD and their contractors, officers, employees, representatives and agents for any injury or damage resulting from their negligence or other acts, however caused, by any contractors, officers, employees, representatives or agents of EFS, DBST during or at Sports, Fitness or Dance Classes, or Baseball Training or Practices or Games.
I hereby release EFS and CM, DBST and SD and their contractors, officers, employees, representatives and agents from all actions, claims or demands that I, my assignees, heirs, distributes, guardians or legal representatives now have or may hereafter have against EFS, or DBST for injuries or damages that I may sustain as a result of participating in any and all Sports, Fitness or Dance Classes offered by EFS and CM, lor DBST and SD.
EFS and/ or DBST may use any photos, names of athletes, or scores to authenticate and verify scores and /or successful experiences at EFS or the EFS system or DBST in general. If used, this information and / or content will be used in a positive and respectful manner, honoring sportsmanship & ethics.
Terms of Service
By default, you will have 6 months to complete your EFS program for programs less than 50 lessons. For 50-100 or more lesson programs you will be allowed 12-18 months to complete the program. Extensions or exceptions can only be granted by an EFS or DBST manager. EFS and DBST reserves the right to change instructors at any time during your program. If you do not provide sufficient notice (at least 24 hours) prior to missing or changing a lesson then you may be charged for the lesson. If an EFS or DBST manager makes an exception to the “no refund” policy, then it will only be in the form of credit toward lessons. The decision or number will be at the sole discretion of the EFS or DBST manager.
Our refund policy involves no cash, credit card, or check funds being returned. But we do allow for an extended expiration for exceptional circumstances. These would include an extreme injury or an extreme sickness, or an extreme hardship. This would have to be approved by an EFS or DBST manager to qualify for this part of our policy. Documentation may be needed to verify injury, sickness, etc… If your reasoning is approved by an EFS or DBST manager and verified then your program can be put on a much longer expiration and used later or shared with another participant if needed. In that case you can also sell your program to another participant (friend or family member) as an option if you choose to.
I have carefully read this agreement and fully understand its contents. By checking “Accept” I am declaring that I am aware that this is a release and waiver of liability, and and I agree to the terms of service outlined here and this serves as a contract between myself and EFS and CM (Chris Morton) or DBST and SD (Scott Dawson) and their contractors, officers, employees, representatives and agents and I check “Accept” of my own free will (or on behalf of my son or daughter). By checking “Accept” I voluntarily agree to the terms and conditions stated above.
